EB-5 processing time point:


1. Applicants who do not have a valid visa that meets the conditions (applicants in China)


A. Submission of Form I-526E can be approved in 2-3 years. After approval, there is a quota for the visa. After a successful appointment, you can go to the Guangdong Consulate for a visa. After approval, you will enter the United States and be issued a conditional green card for 2 years.

B. Submit Form I-829 (to convert to a permanent green card) after 1 year and 9 months of conditional green card. The waiting period is about 2 years.


2. If you have valid visa applications such as F1, H-1B, E2, E3, etc. that meet the conditions, you can submit the I-485 form for identity change and the I-765 work card when submitting the I-526E form in the United States. The I-131 reentry permit can be issued in about half a year, which allows you to effectively stay and work in the United States for a long time and can also enter and exit the country.


For B1/B2 visas, you need to consult an immigration lawyer 90 days after entering the United States to see if you can submit an I-485 to change status because if this kind of visa is common now, it will attract the attention of the immigration bureau and may be considered as immigration fraud in the future. It is best My suggestion is to wait for the normal procedures to submit I-485 to change status.
