Another great opportunity in the new immigration policy is the dual submission policy. Under the new law, EB-5 investors who are already in the United States can submit I-526 and I-485 applications at the same time to solve the problem of legal residency in a very short period of time. EB5 Policy Explained

U.S. EB5 immigrant investor refers to the U.S. immigration law in the EB5 visa category, the full name Employment Based Fifth Preference, is for overseas investors set up by the immigration category. Since its creation in 1990, the EB5 Act has been amended three times, and has now become one of the immigration shortcuts in all immigration categories with short approval time and fewer restrictions.

The EB5 Regional Center Program was officially re-launched on March 15, 2022, raising the investment to $800,000 for Targeted Employment Areas (TEAs) and $1.05 million for non-Targeted Employment Areas (NTAs), and the new regulations have officially gone into effect.

The U.S. Congress passed the Reform and Integrity Act of 2022, which raises the minimum investment amount of EB5 to $800,000, strengthens the regulation of the industry, and sets aside 3,200 visa set-aside quotas to be provided to new investors investing in visa set-aside areas. Currently, there is no scheduling period for visa set-aside category EB5, and applicants can submit I-526E and I-485 in the U.S. at the same time, and immediately realize the legalization of their status in the United States.

The Administrative Appeals Office (AAO) of the U.S. Citizenship and Immigration Services (USCIS) restructured the EB5 program to require investors to provide the lawful source of their EB5 investment funds and to prohibit guarantees of a return on investment.

Introduction of the Regional Center

A Regional Center is a program under the U.S. Citizenship and Immigration Services (USCIS) designed to attract foreign investment and stimulate job creation in America. These centers are designated entities responsible for promoting economic growth, improving regional productivity, creating new employment opportunities, or increasing domestic capital investment.

By investing in a Regional Center project, foreign investors have the opportunity to obtain permanent residency in the U.S., commonly referred to as a green card. To qualify, investors must invest a specified amount into a project within a Regional Center and ensure that this investment leads to the creation of at least 10 full-time jobs for U.S. workers.

One of the primary advantages of Regional Center investment projects, compared to direct investment projects, is that they allow for job creation to be direct, indirect, or induced. This offers greater flexibility to investors and can potentially reduce their risks.

Choosing the right Regional Center is crucial for EB-5 investors as not all centers have the same track record of success. Thus, investors should conduct thorough research and seek expert advice when making decisions.
